Thank you for choosing The Altar as your partner in health, wellness, and personal growth. Whether you are a member or a guest, we are committed to providing a safe, inclusive, and vibrant environment where you can pursue your wellness goals.

For the purposes of these Terms of Service, "The Altar" refers to THE ALTAR LIFESTYLE LLC, along with each of their owners, officers, directors, members, managers, affiliates, agents, principals, employees, instructors, nurses, contractors and volunteers. This definition also extends to any entities (including, without limitation, companies, partnerships, and trusts) owned, in whole or in part, by The Altar, and each of their affiliates and their respective directors, officers, employees, agents, representatives, shareholders, successors, and assigns. In this document, "The Altar" may also be referred to simply as "we" or "us".

For the purposes of these Terms of Service, the term "Participant" or "Participants" refers to any individual who engages with or utilizes any of the Services, as defined below, at The Altar, including both Members and Guests as defined below. In this document, "Participant" may also be referred to simply as "you," simplifying references throughout.

"Member" refers to any individual who has an active membership with The Altar, including those part of the Founding Member Program, which grants them access to the facility, specific services, and events as outlined in their agreement.

"Guest" refers to any individual who accesses The Altar's facilities, services, or events on a temporary or occasional basis without holding an active membership. This includes, but it is not limited to, those who access through purchasing a service or a package of services, redeeming a Gift Card, Free-Pass, complimentary services, or through other means such as corporate partnerships, promotional events, or as guests of a special event hosted by The Altar.

"Plus Ones" refers to any Guest using a "Plus One Pass" from an active Member to access The Altar's facilities, services, or events on a temporary or occasional basis, without holding an active membership.

For the purposes of these Terms of Service, "Service" or "Services" refers to all activities, amenities, facilities, and any other services or products offered and/or sold by The Altar, as well as, but not limited to, visiting or browsing www.the-altar.com, downloading or using the mobile application. This includes, but is not limited to, access to The Atrium (sauna and cold plunge suite), as well The Practice (IV therapy, vitamin shots and other non-medical services, such as compression therapy, hyperbaric chambers, red light therapy, PEMF mats and similar services), wellness programs, classes, events, and any other offerings provided directly by The Altar or through its partners. Services are available to all Participants according to their membership level or access rights, and may be subject to availability, scheduling, and other operational considerations set forth by The Altar.

The following documents are incorporated by reference and are considered an integral part of these Terms of Service:

  • House Rules: A shorter version of the Terms of Service, that outlines the behavioral standards and operational rules that all Participants must follow while on the premises of The Altar.
  • Privacy Policy: Describes how The Altar collects, uses, protects, and shares personal information gathered from Participants.
  • Founding Member Program Agreement and Membership Agreement: Applies specifically to Members and details the terms, conditions, and benefits of The Altar membership.

Acceptance of Terms of Service

These Terms of Service, along with the House Rules, Privacy Policy, and Membership Agreement, are designed to ensure a clear understanding of what you can expect from us and what we expect from you. They collectively govern the use of our facilities, services, and membership privileges, applying to all Participants, whether Members, Guest, or Plus One at The Altar.

By accessing our facilities and services, you acknowledge that you have read, understood, and agreed to be bound by these terms, including the integrated documents mentioned. All Participants are expected to adhere to these provisions. For Members, compliance with both the Membership Agreement and these Terms of Service is mandatory. If you do not agree with any part of these terms, you should refrain from using our facilities or services.

Access Eligibility

To access and use the facilities at The Altar, you must create an account and provide accurate, complete information. You are required to promptly update your account information to maintain its accuracy. Failure to do so, or if there is reason to believe your information is inaccurate or incomplete, may result in suspension or termination of your account and service access.

Additionally, Members must have an active account in good standing. This includes ensuring that there are no past-due balances on the account. Failure to maintain an account in good standing, including timely payment of all dues and fees, may result in restricted access to the facilities until the account is settled. Continued non-compliance may lead to suspension or termination of membership.

By agreeing to these Terms of Service, you declare that you are not a minor and possess the legal capacity to enter into binding agreements independently. You affirm that you are at least 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to meet the terms, conditions, and obligations incurred by the use of The Altar's services. If you are not of legal age or lack the capacity to enter into contracts, you must not accept these Terms of Service and may not use the services provided by The Altar.

Purchase of a Service or a Package

Service Offerings: The Altar offers a diverse range of Services, including various classes and package deals tailored to meet different goals and preferences. Each Service, whether a package or a class, comes with specific terms regarding duration, frequency, and types of activities included. It is your responsibility to thoroughly understand these Terms of Service before making a purchase.

Purchase and Registration: Services such as classes or packages can be purchased either through our online platform or directly at our facility. Full details regarding the cost, number of sessions included, and the validity period of each Service will be clearly stated at the time of purchase.

Cancellation and Refunds: All purchases of Services and packages are final and non-refundable.

Liability and Indemnification Obligations

Participants and Plus Ones shall be obligated for all of its acts in connection with their use of The Altar Services. Additionally, Members are also responsible for their Plus Ones' acts in connection with their Plus Ones' use of The Altar Services. Participants shall be liable for all claims, losses, damages and costs and other liability (collectively, "Claims") to the extent caused by themselves, or by their Plus Ones, in their respective use of, or presence on or about, The Altar Services. The Participant agrees to indemnify, defend (with counsel reasonably acceptable to The Altar) and hold The Altar, their respective affiliates, their respective successors and assigns, and their respective shareholders, partners, directors, officers, members, managers, employees, contractors, representatives and agents (collectively, the "Indemnified Parties"), free and harmless from, against and with respect to all such Claims.

The Participants and each Plus Ones accept and assume all risks and responsibilities associated with use of Services at The Altar premises, including, but not limited to, all risks of bodily injury or damage to property (even if such bodily injury or damage to property is due to the negligence of one or more Indemnified Parties). The Participants acknowledges that if the Member, Guest or Plus One makes or accepts the use of any apparatus, equipment, facility, privilege or service whatsoever owned, leased, made available or operated by any Indemnified Party, or participates in any function or other activity made available, operated, organized, arranged or sponsored by an Indemnified Party, either on or off The Altar premises, then the Participant or Plus One shall do so at his or her own risk. A Member, Guest or Plus One on their behalf hereby releases and agrees to hold all of the Indemnified Parties free and harmless, from, against and with respect to any and all Claims resulting from the matters described above in this paragraph or otherwise arising out of or incident to membership in The Altar or use of The Altar premises and facilities. The Guest or Member and each of the Member's Plus One shall be obligated to execute and deliver such forms, consents, waivers and/or releases of liability and indemnities, as prepared and requested by The Altar from time to time. In the event of any inconsistency between the provisions of this Agreement and the provisions contained in any such consent, waiver and/or release of liability, or indemnity, the provisions contained in the form document shall control.

The failure of The Altar to insist upon a strict performance of any of the terms or provisions herein, of the House Rules or Membership agreement for Members, or to exercise any option, right or remedy contained therein, shall not be construed as a waiver or as a relinquishment for the future of such term, provision, option, right or remedy, but the same shall continue and remain in full force and effect. To the extent that any provision of the Membership Plan, the Rules and/or the Membership Agreement may be held to be invalid or legally unenforceable by a court of competent jurisdiction, the remaining provisions thereof shall not be affected and shall be given full force and effect.

Assumption of Health Risk and Release and Waiver of Liability

You acknowledge that you have voluntarily chosen to participate in services provided by The Altar. You are aware of the strenuous nature of these activities and the potential for serious physical harm, including, but not limited to, abnormal blood pressure, fainting, heart rhythm disorders, stroke, muscular, skeletal, nerve, respiratory, circulatory, and vascular damage, heart attack, or death. You understand these risks may arise from your own actions or inactions, those of others participating in the activities, or the condition of the premises or equipment.

You hereby expressly waive and release any claims you may have now or in the future against The Altar and its affiliates, directors, officers, employees, agents, representatives, and successors. This release covers all liabilities, claims, demands, actions, and causes of action arising from you participation in any activity at The Altar, including those related to The Altar's negligence.

You assume full responsibility for any risks, injuries, or damages, known or unknown, which you might incur as a result of participating in the activities. This includes injuries that may be a result of the negligence of The Altar, its staff, or other participants.

Health Attestations and Unfitness for Participation

No Known Medical Problems: You hereby attest that NO physician has ever informed you that you have a heart condition or that you should avoid activities or Services like those offered at The Altar.

Absence of Risk-Increasing Conditions: You have NO medical problems that would increase your risk of illness or injury as a result of participation in a program or service offered at The Altar facility.

Disclosure of Potential Unfitness: You have NOT withheld from The Altar any reason why you might be unfit to participate in any program or service. Potential unfitness to participate may include, but is not limited to, conditions such as abnormal blood pressure, fainting, disorders of heart rhythm, stroke, muscular damage, skeletal damage, nerve damage, respiratory system damage, circulatory system damage, vascular damage, or heart irregularity.

You agree to immediately stop any activity and seek medical attention if you experience pain or discomfort. You consent to receive medical treatment deemed advisable in the event of injury, accident, or illness during these activities and release The Altar from any liability for such treatment.

This waiver and release are binding on your heirs, executors, administrators, and assigns, in the event of your death or incapacity. By signing this Term of Service, you acknowledge that you understand its terms, and you have given up substantial rights willingly, voluntarily, and without duress.

General Liability Waiver and Service Disclaimer

Service Provision: The Altar provides its services, including websites, applications, and all associated software, content, and materials, on an "AS IS" and "AS AVAILABLE" basis without any warranties, either expressed or implied. To the fullest extent permissible under applicable law, The Altar, including its content providers, disclaims all warranties including but not limited to warranties of merchantability, non-infringement, and fitness for a particular purpose.

Risk Acknowledgment: You acknowledge that participating in or using our services involves certain risks, which may include personal injury and property damage. You assume full responsibility for these risks. Downloading any content through our services is done at your own risk, and you are solely responsible for any damage to your computer system or loss of data that results.

Third-Party Services and Content: The Altar is not responsible for and expressly disclaims all liability related to products, services, or content provided by third parties accessed through our services. This includes any direct, indirect, incidental, consequential, or punitive damages arising from your use or inability to use the services or any content obtained from or through the services.

Medical Disclaimer: Information provided through our services regarding medical conditions, treatments, or therapies is for educational purposes only and should not be considered medical advice. Always seek the advice of qualified health professionals with any questions regarding a medical condition or treatment. You will not make medical decisions without consulting a healthcare provider or disregard medical advice from your healthcare provider or delay seeking such advice based on information as a result of the use of our Services.

Limitation of Liability: To the maximum extent permitted by law, The Altar's total liability for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the services during the twelve (12) months before the claim. The Altar and its content providers will not be liable for any indirect, special, incidental, consequential, or exemplary damages, even if foreseeable.

Jurisdictional Considerations: Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

Benefits Disclaimer: The suggested benefits provided on our website or in any marketing material are intended for informational purposes only and should not be construed as promises or guarantees of results. These suggestions are based on general wellness principles and individual experiences may vary. Always consult with a qualified professional before making any changes to your wellness practices or routines.

Pregnant Women: If you are pregnant, we strongly advise that you consult with your doctor before booking any appointments to ensure that you can safely use our services without any health risks.

Prohibited Behavior

General Expectations: At The Altar, we strive to maintain a safe and enjoyable environment for all participants. To support this, participants must adhere to the following behavior guidelines across all our Services, facilities and locations:

Appropriate Attire:

No public nudity is allowed within the premises. Designated changing areas are provided for undressing. Showers must be used with appropriate bathing wear at all times. Please avoid clothing that is overly revealing, displays intimidating messages or images, or is unsafe for any activities.

Respectful Conduct:

  • Maintain decency; nudity or any exhibitionist behavior is strictly prohibited and may result in criminal charges.
  • Ensure personal media (music, videos) is not audible or visible to others during services.
  • Photography and Phone Use: Taking pictures or videos of others without their explicit consent is strictly prohibited. Phone use should be kept to a minimum and should not disrupt the experience of other guests.
  • Do not interfere with other participants' enjoyment or the operation of sessions, including staff and instructor interactions.
  • Conduct yourself with respect and courtesy towards staff, fellow members, and guests at all times. This obligation extends to all interactions within The Altar's facilities, during activities, events, and any communication related to The Altar's services.

Additional Guidelines:

  • Safe and Proper Use of Equipment: Use all equipment only as intended. Misuse of equipment is prohibited.
  • Sobriety: Participate in services only when sober; the influence of alcohol, marijuana, or other intoxicants is prohibited.
  • Focused Participation: Use electronic devices solely for participating in services; personal calls or other uses during services are not allowed.
  • Compliance with Rules: Follow all specific rules and regulations posted or communicated by instructors or staff, including but not limited to safety procedures and operational instructions.
  • Smoking or Vaping Prohibited: The use of cigarettes, electronic cigarettes, or any form of vaping is strictly forbidden within The Altar's facilities and surrounding areas.

Zero Tolerance for Discrimination and Harassment:

The Altar maintains a strict policy against discrimination and harassment in any form. Immediate suspension or termination of membership or access to facilities may result from any of the following behaviors:

  • Any verbal, physical, or psychological abuse, harassment, or intimidation.
  • Discrimination or hate speech based on sexual orientation, gender identity, age, ethnicity, race, religion, disability, or any other protected characteristic.
  • Threatening language, violence, bullying, racism, sexism, or any other form of intimidation directed at community members or staff.
  • Any disruptive or obstructive actions that negatively impact the experiences of other members or disrupt the operation of The Altar's services.

Enforcement of Rules: The Altar reserves the right to remove any participant from a class, studio, or service for failing to comply with these guidelines. This may include immediate removal, suspension, or permanent ban from future services.

Modifications to Behavior Policy: This list of behaviors is not exhaustive. The Altar reserves the right to modify these guidelines as necessary and determine what constitutes Prohibited Behavior at our sole discretion.

Locker Use and Liability for Personal Belongings

Lockers are provided for your convenience while on-site at The Altar. You are encouraged to secure your belongings in these lockers and ensure that you take all items with you upon departure. Please be aware that lockers are emptied nightly. While The Altar makes every effort to secure removed items, we cannot guarantee their safety once removed from the lockers. If your belongings are removed, they will be held for a limited time for retrieval. Please contact the front desk immediately if you believe your items have been removed from a locker. While The Altar staff will assist in locating lost items, we cannot assume liability for any personal property that is lost, stolen, or damaged. This includes, but is not limited to, items left in lockers, locker rooms, service rooms, or any other areas within the facility. We strongly recommend that you safeguard your valuables and refrain from bringing unnecessary or irreplaceable items to the facility.

Booking and Cancellation Policy

Reservations:

Sessions can be reserved up to 7 days in advance using our online platform or at the front desk. This advance booking helps ensure you secure a spot in your preferred session.

Changes and Cancellations:

To avoid a penalty, you must cancel or modify your reservation at least 12 hours before the scheduled start of the session or class. Cancellations or changes made within 12 hours of the session start time will result in the forfeiture of the booking.

Lateness and No-Show:

You must be physically present at least 5 minutes before the start of your scheduled class or booking. Failure to arrive on time may result in your spot being given to a waitlisted client. If it is your first class or booking you must be present 15 minutes prior to the scheduled class or booking. Arriving late or not showing up will result in the forfeiture of your booking.

Waitlist Management:

If a session is full, you can join the waitlist either through our online booking system or by contacting the front desk. If a spot becomes available, you will be notified via email or text message. Once you are added to a session from the waitlist, you must either attend or cancel according to our cancellation policy. Late changes or cancellations, no-shows, or late arrivals will incur applicable fees. There is no charge for staying on the waitlist if you are not added to a session.

Product Purchases and Return Policy

Product Offerings:

The Altar offers a diverse range of products including supplements, beverages, devices, skincare products, health tests and clothing, each accompanied by specific usage instructions, warranties, or safety guidelines.

We reserve the right to make improvements, discontinue, or change products, features, or services at any time. The availability of our products is not guaranteed and we may limit quantities sold.

Returns and Exchanges:

  • General Policy: Products, excluding classes and membership packages, may be returned or exchanged within 30 days if they remain in new, unworn, unwashed, and unused condition, and are returned in their original packaging. A receipt or proof of purchase is required for all returns and exchanges.
  • Refunds: Eligible items must be returned within 7 days of receipt for a full refund to the original payment method. If a refund to the original payment method is not possible, store credit or an alternative refund method will be provided.
  • Store Credit: Items returned within 30 days in sellable condition qualify for store credit, valid for 1 year after issuance.
  • Non-Returnable Items: Personalized products, supplements, and beverages are not eligible for return or exchange. Final sale items are also exempt from returns and clearly marked at the time of purchase.
  • Swimwear Return Policy: Swimwear can only be returned if it has not been used. To be eligible for a return, the swimwear must be in its original condition with all tags and hygiene liners intact. Used swimwear or swimwear that shows signs of wear and tear will not be accepted for return.

Liability:

The Altar is not liable for health issues that may arise from the use of our products contrary to provided instructions or intended purposes.

Orders and Purchases:

  • Availability and Changes: We reserve the right to modify, cancel, or not process orders due to inaccuracies, insufficient stock, or for any reason at our discretion. If an order is not processed, we will not charge you or will issue a credit.
  • Product Descriptions: While we strive for accuracy, we do not guarantee that product descriptions or other content is accurate, complete, reliable, current, or error-free.
  • Pricing and Specifications: Prices and specifications are subject to change without notice, and products displayed may not be available for purchase.

Promotional Offers

  • Promo Codes, Credits, Discounts, and Other Offers ("Promotional Offers") must be entered at checkout and cannot be applied retroactively after the transaction is completed.
  • Promotional Offers are strictly personal and non-transferable and intended for non-commercial use. Unauthorized reproduction or commercial trade is prohibited, along with any illegal activity related to the purchase and/or use of the coupon.
  • No double discounts. Promotional Offers are non-combinable and are intended for consumer use only, excluding resellers, wholesalers, and practitioners. If a service qualifies for multiple promotions, only the better of the two will be applied.
  • Promotional Offers may be discontinued or voided at any time, and rights to expired or discontinued offers are forfeited, even if they still appear on our website.
  • Promotional Offers Items expire in 90 days unless otherwise defined in their Terms of Service.
  • Promotional Offers may be used to purchase ancillary services and eligible retail merchandise, but can't be put towards membership dues and beverage purchases or any other third party services offered at the space, unless otherwise stated.
  • Promotional Offers must be used exactly as specified on the website or in their Terms of Service within the designated time frame.
  • Coupons valid for a single transaction must be applied in full at the time of purchase. No partial use, cumulative applications, or cash-outs are permitted. You are not entitled to any credit/refund/compensation if there is a difference between the value of the coupon and the redeemed value.

Non-Recording Agreement

As a participant at The Altar, you agree not to record, transmit, or distribute any content captured at The Altar—including videos, audios, photographs, or live streams—without prior written consent from an authorized officer of The Altar. This prohibition extends to all forms of media, including posting on digital platforms and social media.

You may, however, record and share lawful, non-offensive content related to your participation before or after a Service, provided that:

  • You obtain explicit, revocable consent from all identifiable participants featured in the content.
  • You comply with all applicable privacy laws concerning personal data shown in any recordings.

Participants or The Altar may revoke consent for any previously authorized use of images or recordings at any time, upon which the content must be promptly removed from all platforms and deleted.

Violations of this agreement may result in immediate removal from The Altar's services and activities. Furthermore, violators must comply with any requests from The Altar to remove unauthorized content from public view. You also agree to indemnify and hold harmless The Altar, its affiliates, officers, directors, employees, agents, and instructors against any legal actions, claims, damages, or costs (including attorney's fees) arising from any breach of this agreement.

If you observe any unauthorized use of recordings or breaches of this agreement, please report them immediately to The Altar's administration for further action.

Image Release Clause

As a participant at The Altar, you acknowledge that you may be recorded or photographed while engaging in activities at our facilities or during our events. By participating, you grant The Altar and its authorized agents the irrevocable right and permission to capture, use, publish, and distribute any images, videos, or audio recordings that are taken during your participation. These materials may be used for promotional, educational, or any other lawful purposes in our print, digital, and social media platforms.

By agreeing to these terms, you waive any right to inspect or approve the finished product or its specific use. You also waive any claim for compensation associated with the use of these materials. Furthermore, you release The Altar, its directors, officers, employees, and affiliates from all claims, demands, and liabilities whatsoever in connection with the use of your image or recordings.

If you do not wish to be recorded or photographed, please notify The Altar staff upon arrival at our facilities or prior to participating in any activities where recordings might occur.

Information and Content Disclaimer

Our services, including the information provided on our websites, may feature opinions from experts, instructors, or testimonials from users. These opinions and testimonials reflect the personal views of the individuals and are for general information only and not necessarily those of The Altar. Information concerning supplements, diets, or other health-related advice offered through our services should not be considered medical advice or endorsements of effectiveness.

Content related to events and charitable causes is provided for informational purposes only and should not be seen as an endorsement by The Altar. The accuracy, completeness, currency, or usefulness of the information available through our services is not warranted or guaranteed.

Relying on any information provided by The Altar, its employees, affiliates, or any third parties through our services is at your own risk. We may change, withdraw, or restrict access to our content or services at any time without notice. We are not liable for the unavailability of any part of our services or for any reliance placed on the content provided.

We disclaim all warranties to the maximum extent permitted by law regarding the reliability, accuracy, and scientific substantiation of any claims made in testimonials or opinions expressed on our services. Our services do not provide medical advice, make claims about drug effectiveness, or offer treatment for specific conditions.

Neither the Site nor our Services constitute medical advice and are not intended to replace medical advice which should be provided by a qualified and registered healthcare professional. Never disregard professional medical advice or delay in seeking it because of something you have read on the Services.

Termination for Cause

If your account or membership is terminated due to a breach of the Terms and Conditions, you will not be entitled to any refund of fees, including any unused portion of membership or class packages. The following sections will survive the termination of these Terms: (3) Liability and Indemnification Obligations; (4)Assumption of Health Risk and Release and Waiver of Liability; (5) General Liability Waiver and Service Disclaimer; (15) Termination for Cause; (16) Intellectual Property Rights; (19) Disputes, Governing Law; Venue; Waiver of Jury Trial and any other provisions that inherently extend beyond termination.

Intellectual Property Rights

Trademarks: The Altar's icons, graphics, logos, wordmarks, and designs are registered trademarks in the U.S. and other countries, with applications pending. Unauthorized use of The Altar's trademarks and trade dress, including their incorporation into trademarks, domain names, or any use that could cause confusion, is strictly prohibited. These elements may not be copied, imitated, or used, either in whole or in part, without prior written permission from The Altar.

Copyrights and Usage Rights: Materials provided through The Altar's services, including but not limited to names, logos, images, text, graphics, videos, photographs, illustrations, and software, are protected under copyright and trademark law by The Altar or third-party licensors. These materials are available for non-commercial, personal use only. Reproduction, republishing, selling, downloading, posting, transmitting, or distributing these materials in any form without The Altar's express written consent is prohibited.

By using The Altar's services, you agree to respect these intellectual property rights and refrain from any unauthorized use. Violations may result in legal action.

Consent to Electronic Communications

By using our service, you agree to receive electronic communications from us related to your account and the service. These may include notices, agreements, disclosures, or other relevant information, as well as promotional and marketing materials designed to enhance your experience with our services. All electronic communications from us will meet legal requirements for written communication.

You are responsible for any fees charged by your telecommunications or other service providers, including SMS/text messaging, data charges, and other applicable fees.

Service Interruptions and Facility Modifications

Our services, website, social media profiles, communication channels, including access to certain facilities and amenities, may be temporarily or permanently suspended or modified without prior notice due to security requirements, maintenance, system failures, renovations, special events, or other operational needs. You acknowledge that these interruptions or modifications are made in the best interest of the community and are intended to ensure the ongoing provision of high-quality amenities and programs. You agree that you are not entitled to any refunds, rebates, or compensation related to such service interruptions or facility modifications.

Disputes, Governing Law; Venue; Waiver of Jury Trial

This Agreement, and any claims, disputes and matters arising hereunder, will be governed by and construed in accordance with the laws of the State of New York, without reference to its conflicts of law. Should a dispute arise between you and The Altar relating to the Members, we would like to be able to work it out amicably. Therefore, it is requested that you contact us via email at info@the-altar.com in an attempt to resolve any dispute prior to seeking legal action and include your reasons for dissatisfaction. However, should we be unable to resolve any potential dispute within a reasonable time but no longer than 120 days, you agree now that the only method of legal dispute resolution that will be used is binding arbitration before a single arbitrator, selected jointly, in accordance with the American Arbitration Association Rules.

If the Parties are unable to agree upon the selection of an arbitrator within twenty-one (21) days of commencement of the arbitration proceeding by service of a demand for arbitration, the arbitrator shall be selected by the American Arbitration Association. The place of arbitration shall be New York City, New York and New York law shall apply. The decision of the arbitrator shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Each Party shall pay its own proportionate share of arbitrator fees and expenses.

Additionally, you understand and agree now that the only remedy that can be awarded to you through arbitration is full refund of your Membership Fees as of the date of such dispute. No other actions or financial awards of consequential damages, or any other type of damages, may be granted to you. By signing this Agreement, you are agreeing to a modification of the statute of limitations such that any arbitration must be begun within one (1) year of the date of your e-mail to The Altar referenced above, or you waive the right to seek dispute resolution by arbitration or to take any other legal action related to the Services or this Agreement.

You further agree that any arbitration of disputes must be done on an individual basis and cannot be consolidated with any other arbitration or legal proceeding involving The Altar or any other person. You also agree not to participate in any class or representative proceedings against The Altar, and that any dispute between you and The Altar may not be presided over as a class or representative proceeding. By agreeing to arbitration, both parties irrevocably waive the right to a jury trial in connection with any legal proceeding relating to this Membership Agreement.

The Altar is committed to protecting the privacy and security of your personal information. To that end, we have implemented a Privacy Policy that outlines our practices regarding the collection, use, and disclosure of the personal information we obtain from and about you when you interact with The Altar. This includes through our website, any mobile apps, and physical or digital interactions at our studios or events or engagement with any of our services. Copies of the Privacy Policy are available upon request and have been made accessible to you. The Altar's Privacy Policy may be updated periodically, and you are encouraged to review it regularly. By using our services, you acknowledge that you have read and understood the practices described in our Privacy Policy. Continuing to interact with The Altar signifies your agreement to these practices.

We have no control over, assume no responsibility for, and do not endorse or verify the content, privacy policies, or practices of any third-party sites or services. We may maintain a presence on and link to social media websites, including sites such as Facebook, LinkedIn, Google Plus, Twitter, YouTube, Vine, TikTok, Pinterest, Instagram, and others (collectively, "Social Media Pages"), to provide a place for people to learn more about us and our products and to share experiences with our Products and Services. When you visit these Social Media Pages, you are no longer on our Sites, but rather a website operated by a third party. All comments, visuals and other materials posted by visitors to our Social Media Pages do not necessarily reflect our opinions, values or ideas. All visitors to our Social Media Pages must comply with the respective social media platform's terms of use. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. Service Animals and Pets

The Altar is committed to complying with the Americans with Disabilities Act (ADA) by allowing service animals, trained to perform specific tasks for individuals with disabilities, access to public areas of our facilities where other participants are allowed. Participants may be asked to confirm that their animal is a service animal and to describe the task the animal has been trained to perform. The Altar reserves the right to request the removal of a service animal if it is out of control and the Participants does not take effective action to control it, alters The Altar's business or if the animal is not housebroken. You may be charged for any damage caused by your Service Animal. Pets and emotional support animals are not allowed in any The Altar facility area for safety reasons.

We reserve the right to revise or update these Terms of Service and our website as necessary to fulfill our obligations or comply with regulatory requirements. Changes will be effective immediately upon posting to this page, as indicated by the "Last Updated" date at the start of these Terms.
